Dev4Jannah LLC ("Qarya," "we," "us," or "our") operates the Qarya mobile application (the "Service"). These Terms of Service ("Terms") govern your access to and use of the Service. By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Qarya is a community platform designed to help Muslim individuals and families connect with their local mosque community and broader neighborhood. The Service includes a community feed, local marketplace listings, housing listings, service-provider listings, event listings, and private messaging between users.
2. Eligibility
You must be at least 13 years old to create an account. If you are between 13 and 17 years old, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it.
3. Account Registration and Security
To use most features of the Service, you must create an account using email/password, Sign in with Apple, or Google Sign-In. You agree to provide accurate, current information, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at info@qaryaapp.com if you suspect unauthorized use of your account.
4. User Conduct
You agree not to:
- Post false, misleading, defamatory, harassing, hateful, or discriminatory content;
- Impersonate any person or entity, or misrepresent your affiliation with any mosque or organization;
- Post content that is unlawful, infringing, obscene, or violent;
- Use the Service for spam, unauthorized commercial solicitation, or scraping;
- Attempt to access another user's account or interfere with the security of the Service;
- Use the Service in any way that could harm minors or other vulnerable users.
We may remove content and suspend or terminate accounts that violate these Terms, at our sole discretion.
5. User Content
You retain ownership of any text, photos, videos, and other content you submit to the Service ("User Content"). By posting User Content, you grant Qarya a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely to operate, provide, and improve the Service. You represent that you have all necessary rights to the content you post and that it does not violate any third party's rights.
6. Marketplace, Housing, and Service Listings
Qarya provides a platform for users to post and browse marketplace, housing, and service-provider listings. Qarya does not own, sell, rent, inspect, or verify any item, property, or service listed by users, does not process payments, and is not a party to any transaction or agreement between users. We do not conduct background checks on users, mosques, service providers, or landlords, and we make no representations about the identity, qualifications, licensing, or trustworthiness of any user. You are solely responsible for exercising judgment, performing your own due diligence, and taking appropriate safety precautions (e.g., meeting in public places, verifying credentials) before engaging in any transaction or in-person meeting arranged through the Service.
7. Location Services
With your permission, Qarya uses your device's location to help auto-fill your neighborhood and zip code and to show you content relevant to your selected radius. You can change or revoke location permissions at any time in your device settings, though doing so may limit certain features.
8. Messaging
The Service includes a private messaging feature to communicate with other users. You agree to use messaging respectfully and in accordance with Section 4 (User Conduct). We may access message content as necessary to enforce these Terms, respond to legal process, or protect the safety of our users, as described in our Privacy Policy.
9. Mosque and Community Information
Mosque names and affiliations displayed on user profiles are self-reported by users and are not verified or endorsed by the mosques named. Qarya is an independent platform and is not affiliated with, endorsed by, or operated on behalf of any specific mosque or religious institution unless expressly stated.
10. Intellectual Property
The Service, including its design, features, graphics, logos, and the Qarya name and marks, is owned by Dev4Jannah LLC and protected by intellectual property laws. Except for your own User Content, you may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.
11. Third-Party Services
The Service relies on third-party providers, including Supabase (data hosting and authentication), Apple (Sign in with Apple), Google (Google Sign-In and Google Maps), and Expo (application infrastructure). Your use of certain features may also be subject to those providers' own terms and privacy policies.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY USER CONTENT OR LISTING.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DEV4JANNAH LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY INTERACTION WITH ANOTHER USER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
15. Indemnification
You agree to indemnify and hold harmless Dev4Jannah LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your violation of these Terms, or your interactions with other users.
16. Dispute Resolution — Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
16.1 Agreement to Arbitrate. You and Dev4Jannah LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.
16.2 Class Action Waiver. You and Dev4Jannah LLC agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action.
16.3 Opt-Out. You may opt out of this arbitration agreement by emailing info@qaryaapp.com within 30 days of first accepting these Terms, stating your name and that you decline to be bound by the arbitration agreement.
16.4 Informal Resolution First. Before filing an arbitration, you agree to contact us at info@qaryaapp.com to attempt to resolve the dispute informally for at least 30 days.
17. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles, except where preempted by federal arbitration law.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
